Frequently Asked Questions (FAQs):
What is a K-1 Fiancé Visa?
A K-1 fiancé visa allows the foreign partner of a U.S. citizen to enter the United States for the purpose of getting married. The U.S. citizen must file a petition proving a genuine relationship and that they’ve met in person within the last two years. Once approved, the foreign fiancé(e) has 90 days to marry the U.S. citizen after entering the country. If the marriage doesn’t happen within 90 days, the foreign fiancé(e) must leave the U.S.
K-1 Visa for LGBTQ+ couples
A K-1 visa allows a U.S. citizen to bring their foreign fiancé(e) to the U.S. for marriage, and this applies to both same-sex and opposite-sex couples. Since the repeal of the Defense of Marriage Act in 2013, same-sex couples have the same federal rights for this visa as opposite-sex couples. However, it’s crucial to know that the marriage must be recognized by the state where it occurs. Be prepared to show proof of your genuine relationship and be aware that some same-sex couples report extra scrutiny during the application process. After marriage, the foreign spouse can apply for a green card but must wait for approval before working or leaving the U.S.
Marriage-based Green Cards for LGBTQ+ couples
Marriage-based green cards offer a way for the spouses of U.S. citizens or green card holders to become lawful permanent residents, and this includes LGBTQ couples. Since the 2013 repeal of DOMA, same-sex marriages are federally recognized for immigration. The process involves the U.S. partner petitioning for their spouse and usually takes 12-15 months. If the marriage is less than 2 years old when the green card is approved, it will be conditional for 2 years, requiring another application to remove conditions. While green card holders gain the right to live and work in the U.S., be aware that some LGBTQ couples report facing extra scrutiny during the application process. Legal representation is highly recommended; schedule a consultation today.
